Welcome to WinterFlow! Please read these Terms of Service (“Terms”) carefully before using our websites, products, and services (collectively, the “Software”). By accessing or using the Software, you agree to be bound by these Terms. If you do not agree, please discontinue use of the Software.


1. Acceptance of Terms

By accessing or using WinterFlow, you confirm that you have read, understood, and agree to these Terms, as well as our Privacy Policy.

2. Scope and Effective Date

These Terms apply to all visitors and users of the Software and take effect from your first use of WinterFlow.

3. Software Components & Licensing

WinterFlow consists of:

  • WinterFlow Agent (Open Source): A lightweight connector for your servers.
  • WinterFlow Server (Proprietary): The control plane for deployment, updates, and scaling.

By using WinterFlow, you agree to comply with the licensing terms of each component as outlined in their respective documentation.

4. Nature of Service and User Security Responsibility

WinterFlow is a Platform-as-a-Service (PaaS) designed to manage application deployments and, where needed, some configuration for your applications. While WinterFlow may, at its discretion, offer security features, security updates, or ongoing system maintenance for your applications, operating systems, or infrastructure, you remain solely responsible for all aspects of security related to your use of the Software.

You are solely responsible for:

  • Regularly applying security updates and patches to your operating systems, containers, and applications.
  • Configuring and maintaining firewalls, access controls, and user permissions.
  • Monitoring and responding to security incidents.
  • Ensuring compliance with all applicable laws, regulations, and best practices for application and infrastructure security.
  • Implementing and maintaining regular backups of your data, application files, and system configurations. WinterFlow does not perform or manage backups on your behalf unless explicitly stated in your service package.

WinterFlow may facilitate deployment, configuration, or, if explicitly included in your service package, certain security or maintenance actions. However, ultimate responsibility for the security, integrity, and compliance of your systems always remains with you as the user.

By using WinterFlow, you agree to comply with the licensing terms of each component as outlined in their respective documentation.


5. Data Handling

WinterFlow processes deployment actions but does not store your application code, data, or secrets. All application files, databases, and sensitive information remain on servers and infrastructure that you control.

To enhance your experience, WinterFlow may store certain metadata related to your applications and settings (such as application names, icons, configuration preferences, and other non-sensitive information). This metadata enables a more seamless user experience.

6. Metrics and Telemetry

By default, WinterFlow collects certain metrics and telemetry data from your servers and applications. These metrics and telemetry are used to:

  • Provide real-time information in the user interface (UI)
  • Enable notifications regarding the status, performance, and health of your systems
  • Help us monitor, maintain, and improve platform reliability and performance

Examples of collected metrics and telemetry include:

  • Server resource usage (CPU, memory, disk)
  • Application health status
  • Connectivity diagnostics
  • System event logs related to deployment actions and platform interactions

What is not collected:

  • The content of your applications, data, or secrets is never collected or stored by WinterFlow.

You may configure your WinterFlow Agent to opt out of sending metrics and telemetry data to the WinterFlow platform at any time. Instructions for configuring these preferences are available in our documentation or by contacting support.


7. User Accounts

  • All users are required to create and maintain a WinterFlow account to access and use any part of the Software or Services, including self-hosted and managed options.
  • You agree to provide accurate, current, and complete information, and to maintain the security of your credentials.
  • You are responsible for all activities conducted under your account.

8. License Grant & Use Restrictions

We grant you a limited, non-exclusive, non-transferable license to use the Software for personal or commercial purposes, subject to these Terms.

You may not:

  • Use the Software in violation of any applicable laws or regulations.
  • Attempt to disrupt or interfere with the integrity or security of the Software.
  • Distribute, sublicense, reverse engineer, or create derivative works of proprietary components without written permission.

9. Service Packages, Fees, Payments & Refund Policy

All WinterFlow packages are offered exclusively as subscriptions (monthly or annual). The following packages are available:

  1. Virtual Machine with Pre-Installed WinterFlow Agent
    • You may subscribe to a virtual machine (VM) with the WinterFlow Agent pre-installed.
    • Important: You must comply with the terms and acceptable use policies of the original VM provider. Use of these VMs for unlawful, abusive, or prohibited activities (including scams, spam, adult services, unauthorized bots, or any activity violating provider rules) is strictly prohibited.
  2. Additional Packages
    • For users requiring advanced features, additional subscription packages are available. These may include enhanced features, priority support, team collaboration tools, and advanced management controls.

Subscription & Cancellation Policy

  • All packages are provided as recurring monthly or annual subscriptions.
  • If you cancel your subscription during a billing period, you will retain access until the end of your current billing cycle (month or year, depending on plan). No partial refunds are provided for unused time within a billing cycle. However, if you cancel any annual subscription before the end of the annual period, you are eligible for a prorated refund based on standard monthly pricing for actual usage, with the balance returned.
  • All sales are final due to the digital nature of the Software.
  • Refunds may be offered at our discretion in exceptional cases (such as unresolved technical issues caused by us).

10. Third-Party Services

The Software may contain links to third-party websites or services. We are not responsible for their content, terms, or privacy practices. Please review their respective terms and privacy policies.

11. Disclaimer of Warranties

The Software is provided “as is” and “as available,” without warranties of any kind, either express or implied. Use of the Software is at your sole risk.

12. Limitation of Liability

To the maximum extent permitted by law, WinterFlow and its affiliates are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Software, even if we have been advised of the possibility of such damages.

13. User Responsibilities

You are solely responsible for your actions and any content or code you deploy using the Software. We are not liable for any loss or damage resulting from your use of the platform.

14. Third-Party Applications

WinterFlow provides tools to facilitate the deployment and installation of applications. You are solely responsible for selecting, installing, and using any third-party applications through WinterFlow.

WinterFlow does not endorse, review, or warrant the functionality, security, or legality of applications you choose to install. We only provide the installation mechanism; all decisions and risks are yours. Issues arising from the use of third-party applications - including data loss, security vulnerabilities, or performance problems - are your responsibility.

15. Price Changes

We may update our prices as WinterFlow develops and expands. Pricing changes will not affect purchases made prior to the change.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Updates will be posted on this page with a revised “Effective Date.” Continued use of the Software after changes constitutes acceptance of the revised Terms.

17. Termination & Suspension

By WinterFlow:
We reserve the right to discontinue or terminate access to the Software (or parts thereof) at any time, for any reason.

Data Export:
If we terminate the Software, you will have three (3) months from notice of termination to export your data. After this period, all user data will be deleted.

By You:
You may cease using our services at any time. To delete your account or export data, contact us at info@winterflow.io.

18. Governing Law

These Terms are governed by the laws of Canada, without regard to conflict of law principles. Disputes will be resolved exclusively in the courts of Canada.
